Social Media as Evidence: New Legal and Ethical Frontiers

Legal questions raised by the digital sprawl of social media are explored by five prominent Northern California attorneys at a Feb. 3 panel hosted by the UC Davis School of Law. The moderator is Hollis Kulwin, senior assistant dean for student affairs. Seo – Copyright Issues – What You Need To Know

The minute you upload something online you become a publisher. As an online publisher it is your responsibility to know a little bit about copyright law. This book is not a legal guide however here are some of the basic things that you need to know about blogging on the Internet.

First of all if you are going to copy someone else’s material you must ask permission first. This means contacting the author or the publisher and asking them for reprint rights. However sometimes the availability rights are printed right on the article along with information that you must credit to the author. This could include the date of original publication, where it was first published or the name of the publisher if it is from a book. Some articles may not be quoted or reprinted from unless you also provide a link to the URL of the author’s choice.

Crediting an article to its rightful source is called attribution. You must always attribute the work of others and you must do it every time you quote from the article. This is true of direct quotes and paraphrasing. You can’t condense someone else’s writing and then assume that the readers will know that it belongs to ideas that are quoted earlier on in the article. That is called plagiarism.

Another important copyright issue is “fair use.” This is a legally defined terms that allows U.S. citizens to copy and distribute the work of others as long as they adhere to certain legal terms. For instance, in the United States bloggers are allowed to quote sentences and short passages as long as the quote is credited to the author.

However giving credit is sometimes not enough and length may have a great deal to do with what you can replicate on the web. For instance you cannot copy and distribute your favorite piece of music through a web blog. Also laws vary from country to country. Don’t fall for the common myth that it is somehow all right to copy material by writers from other countries just because it is the Internet.

Global media is such a large machine that much of the world’s population is employed by it. On the surface, it seems like media refers only to reporters or newscasters, but behind the front lines there is a huge network of human beings making sure that it is run efficiently and non-stop. Consider that news is a 24 hour, 7 day a week institution. It doesn’t take a holiday when it is Christmas, nor does it take a summer holiday in July as students do. It doesn’t sleep because when it is night in Toronto, it is day in Hong Kong or Japan. News follows the sun as it goes from New York, to Los Angeles, to Australia, then Europe, the Far East and back to North America. There is always something happening and there is always an audience hungry to know what is going on locally and around the world. In each city hundreds if not thousands of people maintain the television stations, cameras, computers, or drive the trucks in search of news. There are people translating news from many different languages to other languages. There are fact-checkers and editors who make sure the news sounds professional. There are lawyers on hand to make sure that what is said does not result in any lawsuits. There are wardrobe consultants to suggest what to wear in front of the camera. There are technical staff to fix things if they are broken. More importantly, there are satellites and fibre optic networks which send the news all around the globe seconds after it happens. All of these activities is just the tip of the iceberg when it comes to what is necessary for you to be able to watch that news program when you get home from work, or read that article in the New York Times as you eat your breakfast, or read a up to the minute website posting on a famous website, www.forbes.com, for example. The media employs many people and hosts many different careers and as a result, students who study media will benefit from this exposure to the true nature of media. Media is a never stopping engine that employs millions of people to deliver news on the more than six billion people of the earth to the more than six billion people of the earth. By studying media we not only think about how we think, but we also explore the career possibilities once we as students leave school behind and enter the work force. Aside from job prospects and details, media is also about communication. When we watch TV, the newscaster is communicating information to us. It is the same with radio, newspapers, and magazine. More recently with the Internet, this communication process has become two sided and as a result, has evolved. For example, blogs on the Internet have recently become one of the most popular sources of news for most individuals. The importance of blogs are a result of many countries like China who regularly censor or lie about what happens when they report the news. The remarkable thing about blogs is that anyone can start one and write in one. The term blog is shortform for web log. One of the key features of a blog is that you can leave comments about what was written and quite often the writer of the blog responds to your comments just as others can respond to your comments. This makes for a dynamic news mechanism. For example, a blog writer, also known as a blogger, might report an item of news. Other people may leave comments on his blog to clarify or provide more information. Others may provide opposing comments to suggest that the news is not entirely correct. Currently, with China blocking all news about what is happening in Tibet, many people around the world are turning to blogs to find out what is going out with the citizens of Tibet and their struggle with the Chinese government. Finally, another benefit of studying media which as we said is about communication is that it makes us better communicators. Newspaper headlines for example, summarize the story and capture attention with just a few words. People who read content on websites, another example, are not interested in lots of useless information. They don’t have the patience to search through paragraphs and paragraphs of text. Let’s not forget how well reporters and newscasters are at public speaking. When newscasters speak they use proper vocabulary and never speak in slang. Their speech isn’t filled with "ums" and "ahs". They look directly at the camera when they speak and always look professional. Students have a lot to learn about communication from the media.

Are Hate Groups on the Rise in America?

 

I live and work out of Baton Rouge, Louisiana. Earlier this week local news “headlined” a story that realy caught me by surprise. The news story stated that about 45 miles southeast of Baton Rouge in the rural Louisiana town of Sun a burutal killing took place. It went on to say that a Klux Klux Klan (KKK) cell located in Sun, Louisiana recruited an Oklahoma woman to join their chapter. Most of teh initial recruiting was done via the internet and  their web site. Once this woman agreed to join she was flown down, for a welcome ceremony, i.e. initiation.

 

During the initiation something went terribly wrong. When the “recruit” changed her mind and decided she no longer wanted to be a part of the group she was killed. The Klan leader killed her in cold blood by shooting her in the back of the head. After this brutal killing took place the local Klan leader and some members went to a local convenience store to clean up. They literally went in the bathroom to wash the blood off. After washing up, the leader mentioned to the convenience store cashier that someone was killed that night in their little town.

 

The cashier had a bad feeling about what she had just been told and called police. After a short investigation 8 members of this KKK cell were arrested on murder charges and are behind bars. Hopefully these animals will never be released and will be forced to pay for their crimes by lethal injection.

 

To be honest, I thought the KKK had faded away years ago. With all the local news coverage this was a big story in Baton Rouge.

 

So I started to do some research on hate groups and was astonished at what I found.

Do you realize there are over 800 active hate groups in the U.S. This site lists the total by state, then drills down to the specific organizations.

 

California has the most with 80 groups actively spreading hate messages throughout the state. The groups include Neo Nazi, Skinheads, Black Separatist, and many more.

 

The list seems to go one forever, but the most important thing and my reason for posting this blog is to educate you. I encourgage you to do your own research and to tell your family and friends.

This is 2008 in America, not 1960 in the deep south. We need to stand strong against these hate groups. Educate your family and friends about this disturbing “trend”. Let them know that there has been an increase of over 48% since 2000. According to the Southern Poverty Law Center hate groups are on the rise in nearly every state.

These groups are very dangerous and they are actively recruiting children as young as 7 years old! The good news is together we can stand up to these hate organizations. You can go to http://www.splcenter.org/center/petitions/standstrong/

In the October 2009 print edition of the UK Column, we reported in our article BBC Hides Truth of Girls Sexual Abuse Ordeal the shocking ordeal of Downs Syndrome girl, Hollie Greig, who was horribly abused by an Aberdeen paedophile ring, over a period of ten years. After investigating and planning a documentary, the BBC abruptly dropped the case, despite admitting that Hollie was a reliable and accurate witness. It is important to stress that both the police and qualified medical experts have described Hollie as a competent and entirely honest witness.

From the age of just six, Hollie was repeatedly sexually abused by her father, Denis Charles Mackie. Later, Mackie began sharing his daughter with a gang of paedophile swingers that has been operating in Aberdeen for many years. The identities of a further seven child victims are already known. There is no question that the gang are well-connected, efficiently organised and totally ruthless. Our frightening story is that they are protected by individuals of high standing within the Scottish establishment.

In 2000, after 14 years of terrified silence, Hollie eventually told her mother, Anne, about the abuses. Formal statements were made to Grampian Police, providing all the horrifying details and the names of the abusers. They included a senior Scottish Sheriff, a policeman, social workers, a nurse, a solicitor, an accountant, a fire officer, married couples and others. Some of the rapes were carried out at the homes of these individuals, including that of the Sheriffs sister. Other children were sometimes involved, including children of the paedophiles themselves.

The latest chapters in this astonishing and horrifying story about Hollie, and the seven other abused children, have taken place over the past few weeks. The key issues are a continued refusal by Grampian police to fully investigate the overwhelming evidence for the paedophile rapes, and a wall of silence by the Scottish establishment.

Whilst there has been some general Scottish media coverage, notably in The Firm and the Aberdeen Press and Journal, the media has been largely silent on what must be one of Scotlands worst top level paedophile scandles. A key figure in the press silence is the Lord Advocate, in her former role as Procurator Fiscal in Aberdeen, when in 2000 she is alleged to have effectively buried the case. Was this to prevent her associate and most influential member of the paedophile ring, Sheriff X, from being investigated, along with the other named members of the fifteen-strong rape gang?

Elish Angiolini, the Scottish Lord Advocate, is in charge of all criminal prosecutions. She is alleged to have reacted immediately to public calls for a full police investigation, by pressurising against publication. Subsequently, and under considerable duress, The Firm published an apology. Shortly afterwards the Press and Journal ran a story accurately describing the case, mentioning a sheriff and police officer without identifying them. Angiolini was not discussed in the article.

Mrs Angiolini`s role in the case recently aroused further suspicion, when it was claimed that she had used a private law firm, Levy and McRae, to issue warnings against all major Scottish editors, threatening them with legal action if any mention was made of her involvement in the case. Suspicious and angry, many individuals directly working to obtain justice for Hollie, as well as a growing number of the general public, now consider that key establishment figures, many with direct responsibility for criminal investigations and justice, have made a concerted and continuous effort to conceal the facts from the people of Scotland. Despite the pressure, investigators and campaigners for Hollie continue to stress that they hold documentary proof of the Lord Advocates actions, as well as proof that she has repeatedly failed to tell the whole truth about her connections with the Hollie abuse case for whatever reason.

The senior partner in the Law Firm, Peter Watson, who is also head of litigation, is understood to have refused to comment as to whether the firms fees have been billed to Mrs Angiolini personally, or if they are being paid by the Scottish taxpayer.

Mrs Angiolinis office decided in December 2009 that they would not pursue the case due to insufficient evidence. Corroborating evidence by private investigators and researchers indicates that other than Hollie, not one of the twenty-four named abusers and victims has even been questioned by Grampian Police
