Fundamental Procedures During Personal Injury Trials

A personal injury trial is a specialized trial. It determines whether one party is liable to pay damages to another injured party. There’s a specific process for how a personal injury trial proceeds.

First there will need to be a jury. The jury isn’t automatically appointed or random. The jury is chosen from a pool of randomly nominated people. Each person who is in this pool is questioned to make sure they will be an impartial judge. Anyone who has a conflict of interest or who may be biased will be left off of the jury.

Next, the attorneys make opening statements. In a personal injury trial, these are overviews of facts that each side suggest indicate that their argument is the correct one.

Victim and witness testimony comes next. In testimony, you can’t discuss rumor, nor can you conjecture about what you think happened. Testimony is where someone describes exactly what happened to them, or what they saw happen to someone. You can only talk about facts that you know from experience, usually.

Cross-examination may occur. If this happens, the opposing counsel questions a witness and reviews their statements, with the goal of exposing inconsistency, bias, or untruthfulness.

Next comes closing arguments. Both sides do these; they are a way to summarize or wrap up the major arguments that have been presented. The closing arguments are the last chance for the two sides to attempt to sway the jury to their interpretation.

These steps are all a way to help the jury be able to make a strong evidence-based determination of fault. They should have a good idea of what really happened in the case, and whose fault it is that injury occurred. They do this by reviewing the data, and then the jury votes whether the plaintiff wins or the defendant wins.

When the jury has decided this they will then give their ruling to the court. In most states it has to be a unanimous decision with all jurors agreeing. In states that this is not required, there still must be an overwhelming majority, of 9 to 3 or better.

Selecting A Personal Injury Attorney Toronto

Anyone suffering from a personal injury or has at some point in their lives understands that this could be a very difficult period of time. Of course, the injuries alone could be devastating and painful while altering any mode of living as well as the insurance companies not willing, in many cases, to cover all the expenses relating to the injury. If this is the case when living in Toronto, one should seriously consider hiring a personal injury attorney Toronto to help with the difficulties during this time.

People suffer from personal injuries often at the hands of various different circumstances and venues that are quite often not the fault of the injured. Often, these injuries are suffered while on the job, in an auto accident, and even at stores and retailers that may not be the fault of the injured. As there are usually an incredible amount of circumstances that lead to these difficulties, there are truly an incredible amount of nuances and difficulties often associated with dealing with the insurance companies.

In the Toronto area, there are plenty of injury attorneys to choose from which is an incredible thing. This could also get a bit confusing as to which ones to choose for any given case. Following a few basic steps will help in the process of getting on the right track to finding the right attorney for you for any given injury issues.

When determining that this is the right move for any injury case, one should first determine what the costs of the injury are at that point. These costs should include anything medical related that has not been covered by the insurance company. There should also be a consideration for lost wages as well as any lost potential wages that have been a result of the actual injury.

One of the first things to look for in a personal injury attorney Toronto is their level of compassion. Basically, this truly is a very difficult time and should be treated as such by any given attorney. During the consultation, pay attention to their demeanor and tone of voice to determine if they are compassionate and sensitive to your needs.

Often, insurance carriers are willing to appoint an attorney to represent the injured at a fraction of the cost of hiring one individually. While this may seem tempting, this should be avoided at all costs. As they work for the carrier, too often, they will be more likely to have the interests of the insurance company in mind as opposed to the injured.

When attempting to find any attorney for this issue, one of the very best places to look is at hospitals and the doctor offices that are visited. Quite often, there are posted flier ads and information within the halls that are a common source. Quite often, the doctor of medical professionals will have referrals or be able to point someone in the right direction.

Finding Personal injury lawyers Toronto is also as easy as searching online or through other advertising arenas. When using this process, there should actually be quite a few that are called and met with to see if they are the right one. Never just deal with the first one that is called.

Hold Israel Accountable – Palestine Legal Aid Fund

Urgent Appeal – Legal Action on Gaza Aid Flotilla – by Palestine Legal Aid Fund (http://www.humanrightsfund.org )

Mary Nazzal-Batayneh of the Palestine Legal Aid Fund urges you to support the appeal for legal action following Israel’s attack on the Freedom Flotilla.

As soon as Israeli commandos attacked, the need for an international effort to secure and preserve evidence from passengers was clear.

A single donation to the Palestine Legal Aid Fund was all that was necessary to give the go ahead to UK-based lawyers to start preparing advice for the detainees, and coordinating the international collection of evidence for use in any future legal case or UN fact-finding mission.

The legal cases will not only seek justice for those killed, injured and detained on the flotilla. They will hold Israeli authorities legally accountable, and provoke an examination of the illegal blockade and humanitarian crisis in Gaza.

Your help is needed to support this vital work. Through making a donation, fundraising in your community, or showing your support in another way, you can ensure this work continues, and that the strongest possible case reaches court. Take action: sign up at www.humanrightsfund.org

Scottish Paedophile Ring Involving Cops, Lawyers, Covered Up !! Lord Advocate Implicated. P4of5

REGULAR UPDATES FROM HOLLIE’S BLOG HERE : http://stolenkids-hollie.blogspot.com/

UPDATE ON ROBERT GREEN ARREST HERE : http://www.pressandjournal.co.uk/Article.aspx/1604682/

Earlier report on Hollie Greig’s abuse case here : http://www.ukcolumn.org/2010/02/02/child-rapists-protecte…

In the October 2009 print edition of the UK Column, we reported in our article BBC Hides Truth of Girls Sexual Abuse Ordeal the shocking ordeal of Downs Syndrome girl, Hollie Greig, who was horribly abused by an Aberdeen paedophile ring, over a period of ten years. After investigating and planning a documentary, the BBC abruptly dropped the case, despite admitting that Hollie was a reliable and accurate witness. It is important to stress that both the police and qualified medical experts have described Hollie as a competent and entirely honest witness.

From the age of just six, Hollie was repeatedly sexually abused by her father, Denis Charles Mackie. Later, Mackie began sharing his daughter with a gang of paedophile swingers that has been operating in Aberdeen for many years. The identities of a further seven child victims are already known. There is no question that the gang are well-connected, efficiently organised and totally ruthless. Our frightening story is that they are protected by individuals of high standing within the Scottish establishment.

In 2000, after 14 years of terrified silence, Hollie eventually told her mother, Anne, about the abuses. Formal statements were made to Grampian Police, providing all the horrifying details and the names of the abusers. They included a senior Scottish Sheriff, a policeman, social workers, a nurse, a solicitor, an accountant, a fire officer, married couples and others. Some of the rapes were carried out at the homes of these individuals, including that of the Sheriffs sister. Other children were sometimes involved, including children of the paedophiles themselves.

The latest chapters in this astonishing and horrifying story about Hollie, and the seven other abused children, have taken place over the past few weeks. The key issues are a continued refusal by Grampian police to fully investigate the overwhelming evidence for the paedophile rapes, and a wall of silence by the Scottish establishment.

Whilst there has been some general Scottish media coverage, notably in The Firm and the Aberdeen Press and Journal, the media has been largely silent on what must be one of Scotlands worst top level paedophile scandles. A key figure in the press silence is the Lord Advocate, in her former role as Procurator Fiscal in Aberdeen, when in 2000 she is alleged to have effectively buried the case. Was this to prevent her associate and most influential member of the paedophile ring, Sheriff X, from being investigated, along with the other named members of the fifteen-strong rape gang?

Elish Angiolini, the Scottish Lord Advocate, is in charge of all criminal prosecutions. She is alleged to have reacted immediately to public calls for a full police investigation, by pressurising against publication. Subsequently, and under considerable duress, The Firm published an apology. Shortly afterwards the Press and Journal ran a story accurately describing the case, mentioning a sheriff and police officer without identifying them. Angiolini was not discussed in the article.

Mrs Angiolini`s role in the case recently aroused further suspicion, when it was claimed that she had used a private law firm, Levy and McRae, to issue warnings against all major Scottish editors, threatening them with legal action if any mention was made of her involvement in the case. Suspicious and angry, many individuals directly working to obtain justice for Hollie, as well as a growing number of the general public, now consider that key establishment figures, many with direct responsibility for criminal investigations and justice, have made a concerted and continuous effort to conceal the facts from the people of Scotland. Despite the pressure, investigators and campaigners for Hollie continue to stress that they hold documentary proof of the Lord Advocates actions, as well as proof that she has repeatedly failed to tell the whole truth about her connections with the Hollie abuse case for whatever reason.

The senior partner in the Law Firm, Peter Watson, who is also head of litigation, is understood to have refused to comment as to whether the firms fees have been billed to Mrs Angiolini personally, or if they are being paid by the Scottish taxpayer.

Mrs Angiolinis office decided in December 2009 that they would not pursue the case due to insufficient evidence. Corroborating evidence by private investigators and researchers indicates that other than Hollie, not one of the twenty-four named abusers and victims has even been questioned by Grampian Police

*** About the Walk For Liberty

What are you willing to do for freedom?

Vote? Protest? Participate in a rally? Walk all the way across the country?

We are.

This summer, a group of activists will be walking across America to achieve more freedom and liberty.

Our pioneer forefathers trekked across the continent from the east to the west to find a better life for themselves. This time, we’re doing it in reverse.

I am walking coast-to-coast across the country, from Oregon to New Hampshire. I am joined by my immediate family as well. We’re on a quest to gain more freedom for ourselves and for our country by spreading the message of freedom and liberty along the way.

Why are we doing this?

We see the gradual chipping away at freedoms in America, and want to do our part to stop it. My wife and I are moving to New Hampshire as part of the Free State Project. New Hampshire is already the freest state in the country, which is why we are moving there. But we also want to help bring more freedom to as many other people as possible.

Therefore we are walking across America to get to New Hampshire. We are walking all the way there to bring as much media attention and publicity as possible to two liberty-oriented causes: the Free State Project, which is working to make New Hampshire even more free, and Ron Paul’s message of freedom for everyone.
